Terms and Conditions of Service


Welcome to tkx.

Our mission is to cultivate and foster a vibrant community of venues, artists, promoters, and music lovers through the power of live entertainment. To that end, we must do everything possible to make the journeys of the music lovers, venues, artists, and promoters smooth.

These Terms of Service (Terms) reflect that mission. By using tkx you agree to comply with and be bound by these Terms.

tkx is an event management platform. tkx facilitates the sale of tickets on behalf of promoters, venues, and approved ticket sellers for live entertainment (hereafter referred to as “Event Managers”). tkx is not directly involved with and has no control over the production, modification, or listed events provided by the Event Managers. Contact the Event Managers for any terms of purchase and refund policies related to your purchase.


Pricing and Availability

Event Managers set the number and price of available tickets for an event. Pricing and available tickets may change over time. Please visit the tkx website to see changes in availability.

When you have successfully added tickets to your cart for an event or events, tkx requires a purchase be completed within the displayed time period. Failure to complete the transactions within the displayed time period ends the transactions. You will have to begin the purchase process again at the risk of changes in price or availability of your desired ticket or tickets.


Errors

If, for any reason, you purchase a ticket at a time or price not approved by the Event Managers. We reserve the right to cancel the transaction and issue a refund.


Purchasing

Before you buy your ticket, please carefully read all event details. Please make sure you have selected the correct time, date, quantity, and type of ticket you are purchasing. Please understand the Event Managers rules and guidelines listed on the event page.

Both tkx and the Event Managers may put conditions on your use of promotional discounts and codes. Please check those conditions when you receive them.


Order Confirmation

After you have made sure your order is correct, make your purchase. By making that purchase, you agree to pay in full through the payment methods you are authorized to use.

After completing your purchase, you will receive an email with your order confirmation. You may also view your tickets by logging into your tkx account.

If you do not receive a confirmation email, please contact tkx or the Event Manager to check the status of your order. If you contact tkx, please include all the details you have on the transaction.


Using Your Tickets

After you purchase your ticket or tickets, please keep them in a safe place. and don’t let anyone Do not give others access to your email account where they can print duplicates. Tickets will be scanned at entry. If your ticket has already been scanned, your ticket will not be accepted and you will not be allowed admission to the event.


Scheduling changes & Cancellations

Scheduling changes and cancellations are not in tkx‘s control. tkx works with its Event Managers to be fair and give as much advance warning as possible. However, tkx cannot guarantee that you will not be inconvenienced by the change or cancellation of an event.

Please contact the Event Manager if an event has been changed, rescheduled, or canceled for further information.


Refunds

All purchases on tkx‘s Website are final and cannot be exchanged for tickets for another event. Tickets are a revocable license. Admission can be refused at the Event Manager’s discretion and policy. Tickets cannot be redeemed for cash. Initially, please contact the Event Manager for any refund.


Transferring your ticket

If you would like to transfer a ticket, you will need to have a tkx account. If you choose to transfer your ticket, you will no longer have control over that ticket. It will appear in your order history, but the transferee will have control over the ticket once the ticket is transferred and accepted by the transferee.


Resales are not allowed

tkx can only guarantee the authenticity of tickets purchased directly on the tkx website.

Some states restrict the maximum resale value of tickets. If you choose to resell your ticket, you are responsible for following all relevant laws within your state or jurisdiction. Your tickets are for individual use only and are not allowed to be used in sweepstakes or promotions without written preauthorization by tkx.


Admission and Ejection

The Event Manager always reserves the right to refuse admission to, or remove, anyone who the Event Manager believes is violating the law, is disorderly, has a communicable disease, such as Covid19, or is noncompliant with respect to safety measures, or otherwise violates any rule of the Event Manager. Those measures may subject you and your personal belongings to a search when you enter the event location.


Conduct

In the event of dispute or chargeback from your credit card company on a valid purchase, tkx reserves the right to cancel tickets associated with those transactions. tkx may, under appropriate circumstances, decline to honor credit card purchases associated with related accounts.


Termination of services

tkx reserves the right, without liability to you or a third party, to modify , suspend, or discontinue any part of the tkx website at any time without notice.

Should you decide you wish to cancel your tkx account, or no longer agree to abide by these or other tkx Terms or Conditions, you may cancel your account at any time by contacting tkx support. Should tkx find you have violated these Terms, tkx reserves the right to deactivate your account. In the event tkx deactivates your account, you will be notified by email.


Links

The tkx website may contain links to other websites that are not under tkx control. tkx is not responsible for and does not endorse the content of those websites or those websites’ operators.


Advertising

Prices advertised on the tkx website supersede any price that was circulated on released marketing materials.


Claims of Copyright Infringement

All content on the tkx website is either property of tkx or licensed property of the Event Managers. All such content is fully protected by intellectual property laws. All registered trademarks, logos, and service marks may not be used without the expressed written permission of tkx.


Modifications

Please visit the tkx website for the most updated version of this agreement. We reserve the right to change all terms and conditions.


Limitation of Liability

IN NO EVENT WILL tkx, ITS SUPPLIERS, ADVERTISERS AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY TYPE OTHER THAN OUT OF POCKET EXPENSES, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE OF ANY TICKETS OR PRODUCTS FROM tkx, THE CONTENT, OR ANY PRODUCT OR SERVICE PURCHASED THROUGH THE tkx WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT tkx WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR (a) ANY FAILURE OF tkx TO CONFORM TO THE CODES OF CONDUCT, (b) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, WHETHER ARISING IN CONTRACT OR IN TORT, RESULTING FROM YOUR ACCESS TO AND USE OF THE tkx WEBSITE ITS PRODUCT OR SERVICES, (c) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (d) ANY BUGS, VIRUSES, WORMS, TROJAN HORSES, DEFECTS, DATE BOMBS, TIME BOMBS OR OTHER ITEMS OF A DESTRUCTIVE NATURE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SITE, (e) ANY ERRORS, MISTAKES, INACCURACIES OR OMISSIONS IN ANY CONTENT, OR (f) ANY LOST, STOLEN OR DAMAGED

TICKETS, OR THE FAILURE OF A VENUE TO HONOR A TICKET. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE tkx WEBSITE, ITS PRODUCTS OR SERVICES IS TO STOP USING THE SITE OR RETURN ANY UNUSED TICKET AND REQUEST A REFUND. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THE ALLOCATION OF RISK BETWEEN US (tkx and you) IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. THE AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE USE OF THE tkx WEBSITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID tkx IN THE PAST TWELVE MONTHS. IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE. OUR LIABILITY WILL BE LIMITED UNDER THIS PARAGRAPH TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND THE PROVISIONS OF THIS PARAGRAPH WILL NOT APPLY TO THE EXTENT APPLICABLE LAW PERMITS THE RECOVERY OF DAMAGES, ATTORNEYS’ FEES OR COSTS

OTHERWISE PROHIBITED UNDER THIS PARAGRAPH.


Arbitration and Disputes

NY DISPUTE, CLAIM, OR CAUSE OF ACTION IN ANY WAY RELATED TO THE TICKET OR THE EVENT SHALL BE RESOLVED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION IN ORANGE COUNTY, FLORIDA BEFORE A SINGLE ARBITRATOR APPPOINTED BY THE AMERICAN ARBITRATION ASSOCIATION. YOU AND tkx AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS. YOU UNDERSTAND, ACKNOWLEDGE, AND AGREE THAT YOU ARE WAIVING YOUR RIGHT TO A COURT OR JURY TRIAL AND ANY RIGHT TO LITIGATE OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. IF YOU DO NOT CONSENT TO THIS CLAUSE, YOU MUST NOT PURCHASE A

TICKET, OR LEAVE OR NOT ENTER THE EVENT FOR WHICH THE TICKET IS DESIGNATED AND RETURN YOUR TICKET FOR A REFUND. THIS CLAUSE IS GOVERNED BY THE FEDERAL ARBITRATION ACT.


Completeness

These Terms constitute the entire agreement between tkx and its users. These Terms represent the entire understanding and supersede all prior understanding between tkx and its users, and cannot be changed or terminated.
